Many people are confused between bluejacking and blesnarfing. While both exploit bluetooth vulnerability, Bluetooth is sesentially benign as it involves the sending of infomation (usually messages) to another bluetooth device without authorisation. But bluesnarfing is about "stealing" information from another victim.

So it is not surprising bluesnarfing is illegal while bluejacking is not.
